# Responsibility of operating company

> Understand the responsibilities of the operating company when using Wandelbots NOVA. Ensure legal compliance and safe implementation of the platform.

Wandelbots GmbH delivers the HMI software and the necessary tools to define a process flow.
The operating company is responsible for the HMI hardware and the definition of a process flow that can be created with Wandelbots software.

> **⚠️ WARNING:** Safety features and functionalities are not controlled by Wandelbots NOVA. The operating company is responsible for equipping the robotic environment with the necessary external safety components and defining user groups to ensure safety instructions are complied to.

After substantial changes of the machinery, the operating company is responsible of verifying if recertification is necessary.
This ensures compliance to the EU Machinery Regulation 2023/1230.

## Operating company

The operating company is considered to be the people who operate Wandelbots NOVA themselves for
commercial or economic purposes or permit third parties to use it and therefore
bear the legal product responsibility for the protextion of users or
third parties during operation.

## Operational duties

The operating company of Wandelbots NOVA will always be subjected to the legal obligations regarding occupational safety.
In addition to the safety instructions in these safety instructions, the safety, occupational health and safety and environmental protection regulations which are applicable to the area of
application of Wandelbots NOVA must always be complied with.

The following applies in particular:

- The operating company must obtain knowledge about the
  applicable occupational health and safety regulations and, in
  a risk assessment, identify additional hazards which can result from the special working condisition at the location where
  Wandelbots NOVA will be used. The operating company must implement this as operating instructions for the operation of Wandelbots NOVA.
- The operating company must know the operational environment of Wandelbots NOVA and the associated hazards and how to prevent them.
- The operating company must learn about and implement the
  safety regulations of the robot manufacturing company and
  the companies of other parts, machinery, equipment, systems
  and plant which are used in the robot system.
- The operating company must be aware of the robot manufacturing company's safety devices, e.g. EMERGENCY STOP button, instruct the users and point out possible dangers.
- During the entire period of use of Wandelbots NOVA,
  the operating company must inspect whether the operating
  instructions which it has created, always correspond to the
  current status of the regulations and, if necessary, adapt them.
- The operating company must clearly regulate and define the
  responsibilities for installation, operation, troubleshooting, servicing, maintenance and cleaning.
- The operating company must ensure that the systems cannot
  be confused by labelling the robots.
- The operating company must ensure that amendments to the
  operating mode and alterations to the safety devices are only
  executed by authorized personnel (key, password protection).
- The operating company must ensure that all personnel that will
  work with Wandelbots NOVA have read and understood this documentation.
- The operating company must provide the users with the locally
  required protective equipment and must instruct and monitor
  the wearing of the protective equipment.
- The operating company must update the software regularly as
  described in these operating instructions.
- The operating company must have all of the robot's safety devices inspected and tested regularly for functionality and completeness.
- The operating company must execute the required inspections and tests - before commissioning; after alterations and/
  or amendments which require verification; after recurring inspections and tests - according to the Operational Safety Ordinance (issue date: Feb 03, 2015) and DGUV Regulation 3.
- The operating company will execute the electrical safety test
  and the test and inspection for the safety functions of the robot application.
- The operating company will specify the test conditions separately. The test conditions (type of test, scope of test, test
  deadlines and the commissioned test executors) depend on
  the work equipment application.
- Depending on the application-specific hazards in its risk assessment, the operating company can also permit the use of
  the robot application with Wandelbots NOVA in the
  set up life phase. In this case, additional conditions must be
  complied with in order to ensure that, e.g. the used end effector or other components do not pose a hazard to the user.
- The operating company must permanently mark all danger areas of the robot application with suitable safety signs
